Welcome to Hognose Hub. These Terms of Service ("Terms") are a legal agreement between you and Hognose Hub ("we," "us," "our"), a business operated as a sole proprietorship under the registered trade name "Hognose Hub" in Ohio, United States.
By creating an account, making a purchase, or otherwise using hognosehub.com and its services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
Please also read our Privacy Policy, which explains how we handle your information and is incorporated into these Terms.
Who can use Hognose Hub
You must be at least 13 years old to create an account, or at least 16 if you are in the European Union or United Kingdom. By creating an account, you confirm that you meet this requirement.
If you are under 18, you may use the Service only with the involvement of a parent or guardian.
Your account
When you create an account, you agree to:
- Provide accurate information and keep it current
- Keep your password confidential and not share your account
- Be responsible for everything that happens under your account
- Maintain only one account, unless we agree otherwise
You may delete your account at any time by emailing hello@hognosehub.com.
We may suspend or terminate your account if you violate these Terms, if we're required to by law, or to protect the Service and its users. If we terminate your account for a serious violation, you may lose access without a refund.
Community conduct
Hognose Hub includes a community forum. When you post, comment, or otherwise participate, you agree to follow our Community Guidelines.
In short: be respectful, stay on topic, don't harass others, don't post illegal content, and don't spam or advertise without permission. We moderate the community and may remove content or restrict accounts that break these rules.
Content you post
You keep ownership of everything you post to Hognose Hub — your forum posts, comments, and any images or text you contribute.
By posting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and distribute that content as part of operating and promoting the Service. This license exists only so we can show your posts to other members and run the community. It ends when you delete your content or your account, except where we've already used it (for example, in a quote another member replied to) or where we must retain it for legal or moderation reasons.
You are responsible for the content you post. You confirm that you have the right to post it and that it does not violate anyone else's rights or any law.
Breeder program
Breeders who are invited and choose to participate in the breeder merch program agree to additional expectations communicated during onboarding, including providing accurate business information and appropriate imagery. We may decline, remove, or unpublish a breeder profile at our discretion. Participation does not create an employment, partnership, or agency relationship.
Purchases and merchandise
Our store sells print-on-demand merchandise. Orders are processed through Shopify and fulfilled by Printify.
- Checkout and payment happen on Shopify's hosted checkout. When you buy, you also agree to Shopify's terms for that transaction.
- Prices are shown in the store and may change at any time before purchase.
- Fulfillment and shipping are handled by Printify. Production and delivery times vary. See our Shipping Policy.
- Returns, refunds, and problems with an order are covered by our Refund Policy.
We are not responsible for delays, errors, or issues arising from Shopify's or Printify's systems, though we'll do our best to help resolve problems.
Memberships and digital access
Some parts of the Service — such as Academy content, the members-only community, and software tools — are or will be available through paid membership tiers.
Digital memberships and digital content are non-refundable. Once you purchase or upgrade a membership, or access digital content, we do not offer refunds for that purchase, except where a refund is required by applicable law. If you cancel a membership, you keep access through the end of your paid period and are not charged again.
Membership features may change, launch, or be discontinued over time. We describe features honestly, but availability of any specific feature is not guaranteed.
Our content and intellectual property
The Service and its original content — including our articles, guides, infographics, graphics, branding, and software — are owned by Hognose Hub or our contributors and are protected by intellectual property law.
How you may and may not use our educational content is set out in our Content Use Policy and Content & Attribution Policy. Please read them before sharing or republishing our materials.
Educational content is not professional advice
Hognose Hub provides educational information about keeping and breeding Western Hognose snakes. This information is educational only and is not veterinary, medical, legal, or professional advice.
Husbandry practices evolve, and reasonable experts disagree. You are responsible for the care of your animals and for complying with the laws that apply to you. For health concerns about a specific animal, consult a qualified reptile veterinarian. We are not liable for outcomes resulting from reliance on our educational content.
Third-party services and links
The Service relies on and links to third parties — including Supabase, Vercel, Shopify, Printify, Resend, Chatbase, and links to breeder websites, social media, and marketplaces such as MorphMarket.
We don't control these third parties and aren't responsible for their content, products, or practices. Your use of a third-party service is governed by that party's own terms.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, Hognose Hub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.
Our total liability to you for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) fifty U.S. dollars.
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you. In the EU and UK, nothing in these Terms limits rights you have that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless Hognose Hub from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your content, or your misuse of the Service.
Changes to these Terms
We may update these Terms as the Service changes. When we make material changes, we'll update the date at the top and notify members by email or an in-site notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules.
Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the jurisdiction of those courts. Nothing here prevents either party from seeking injunctive relief where appropriate.
If you are a consumer in the EU or UK, you may also have the right to bring proceedings in your country of residence, and mandatory consumer protections in your jurisdiction still apply.
Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
